Opening Arguments to Begin in First DePuy State Court Trial
Opening arguments are set to begin this week in what will be the first lawsuit against DePuy Orthopedics, Inc. to go to trial over the company’s recalled ASR hip implant. The case, styled Jackson v. DePuy Orthopaedics Inc., CAL 10-32147, was commenced in Prince George’s County Circuit Court in Upper Marlboro in Maryland and pits Plaintiff Moira Jackson, a former professional dancer who received two faulty DePuy hip implants, against the Johnson & Johnson’s subsidiary responsible for designing and manufacturing those implants.
Moira Jackson Takes On DePuy in Maryland State Court
According to court filings in Ms. Jackson’s lawsuit, DePuy’s faulty ASR hips caused her “severe physical distress and injury” and left her unable “to lead a normal life.” Ms. Jackson is seeking at least $15 million in damages, according to the filings.
Johnson & Johnson’s 2010 recall applied to 93,000 ASR hip implants that had already been distributed all around the globe. Roughly 37,000 were reportedly implanted in the United States, and more than 12 percent of them failed within five years. Experts have found that metal debris from the cobalt and chromium alloy in the implants can cause tissue death around the hip joint and can increase metal ions in the bloodstream to harmful levels. Thousands of lawsuits have already been filed in state and federal courts in the United States, but many more implant recipients might still be eligible to sue.
